General Terms and Conditions of the MegaBooking.eu internet portal

I. Introductory Provisions and Definitions
1.1. These General Terms and Conditions (hereinafter referred to as "T&C") govern the rights and obligations of persons using the MegaBooking.eu portal.
1.2. Operator: Dušan Šroba - DATACLICK, Andreja Bažíka 31/102, 027 32 Zuberec, Slovak Republic. ID (IČO): 44281820, Tax ID (DIČ): 1074386434, VAT ID: SK1074386434. Registered in the Trade Register of the District Office Námestovo, No. 560-12730.
1.3. Accommodation Provider (Host): A natural or legal person who advertises accommodation capacities (properties) on the portal.
1.4. Visitor (Guest): A person who uses the portal to search for accommodation and contact the Accommodation Provider.
II. Nature of the Provided Service
2.1. The MegaBooking.eu portal is exclusively an advertising medium. The Operator provides a technical platform to connect the Accommodation Provider and the Visitor.
2.2. The Operator is not an accommodation broker within the meaning of the Act on Package Tours, nor is it a travel agency or agent. No payment for the accommodation itself takes place via the Operator's portal.
2.3. The accommodation contract is concluded directly between the Accommodation Provider and the Visitor. The Operator bears no responsibility for the fulfillment of this contract, the quality of accommodation, or any potential damages.
III. Marketing System and Discounts
3.1. The Operator carries out a marketing campaign under the brand MegaBooking.eu to increase the attractiveness of the advertised properties.
3.2. The Accommodation Provider agrees to provide a 5% discount from the standard rack rate to any Visitor who provides the password "MegaBooking.eu" upon contact.
3.3. Pricing: The Accommodation Provider has full control over the prices listed in the advertisement. The Accommodation Provider acknowledges that the prices entered on the portal should be set to account for this mandatory discount. The Operator bears no responsibility for the economic results of the Accommodation Provider.
IV. Advertising and Payment Conditions
4.1. Advertising is subject to a fee according to the valid price list. Prices are listed excluding VAT (Reverse Charge applies for foreign VAT payers) or including VAT according to the status of the customer.
4.2. Activation: The advertisement (Your accommodation) is activated upon receipt of payment into the Operator's account. Until then, the listing remains in an "inactive" status.
4.3. Digital Content: The service is considered fully delivered at the moment the advertisement is published. In accordance with legal regulations on consumer protection, the Accommodation Provider loses the right to withdraw from the contract after the advertisement is published, as this constitutes the provision of electronic content at the consumer's request.
V. Rights and Obligations of the Host
5.1. The Host declares that they possess all rights to the photographs and texts used in the advertisement.
5.2. The Host is obliged to provide truthful contact details. It is forbidden to mislead the Visitor regarding the location or price of the property in the advertisement text.
5.3. The Operator is entitled to suspend an advertisement without compensation if there are repeatedly verified complaints from Guests against the Host regarding the breach of agreements.
VI. Final Provisions
6.1. These T&C are governed by the legal order of the Slovak Republic. For international users, consumer protection provisions according to EU regulations apply.
6.2. The supervisory body is the Slovak Trade Inspection (SOI), Bajkalská 21/A, Bratislava. In the event of disputes, the consumer has the right to Alternative Dispute Resolution (ADR).
